These Terms of Service ("Terms") govern your access to and use of the Sip Steward platform, including our website, applications, and services (collectively, the "Service") operated by Sip Steward ("we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.
You must be at least 21 years old (or the legal drinking age in your jurisdiction) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.
2. Description of Service
Sip Steward provides a comprehensive wine production management platform that includes:
- Batch tracking and management
- Recipe creation and version control
- Fermentation monitoring and logging
- Inventory management
- AI-powered supply identification
- Task scheduling and reminders
- Production analytics and reporting
- Tasting notes and quality tracking
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.
3. Account Registration and Security
3.1 Account Creation
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.
5.3 Data Portability
You may export your data from the Service at any time through the available export features. We support standard data formats to ensure portability.
6. Intellectual Property Rights
6.1 Our Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Sip Steward and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

7. Subscription and Payments
7.1 Beta Period
During our beta period, the Service is provided free of charge to selected users. We reserve the right to introduce paid subscription plans at any time with advance notice.
7.2 Future Pricing
When we introduce paid plans:
- Beta users will receive advance notice before any charges apply
- Subscription fees will be billed in advance on a recurring basis
- You authorize us to charge your payment method for all applicable fees
- All fees are non-refundable unless otherwise specified
7.3 Price Changes
We reserve the right to modify subscription prices with 30 days' advance notice. Your continued use after price changes constitutes acceptance of the new pricing.

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
9. Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
9.2 No Guarantee
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- The quality of the Service will meet your expectations
- Any errors in the Service will be corrected
9.3 Winemaking Disclaimer
IMPORTANT: Sip Steward is a management tool only. We do not provide winemaking advice, guarantee winemaking success, or ensure compliance with local regulations. You are solely responsible for:
- Complying with all applicable laws and regulations regarding alcohol production
- Ensuring the safety and quality of your products
- Obtaining necessary licenses and permits
- Following proper winemaking practices and safety procedures
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIP STEWARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, REVENUE, DATA, OR USE
- DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
- DAMAGES RESULTING FROM ANY THIRD-PARTY SERVICES OR CONTENT
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Sip Steward and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
- Your winemaking activities
12. Dispute Resolution
12.1 Informal Resolution
Before filing a claim, you agree to try to resolve any dispute informally by contacting us through our contact form. We'll try to resolve the dispute informally by contacting you via email.
12.2 Binding Arbitration
If we cannot resolve a dispute informally, any dispute arising from these Terms or the Service will be resolved through binding arbitration, except that either party may seek equitable relief in court for intellectual property infringement.
12.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTES WILL BE RESOLVED INDIVIDUALLY AND NOT AS A CLASS ACTION OR REPRESENTATIVE ACTION.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in California.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. For significant changes, we will provide additional notice through the Service or via email.
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sip Steward regarding the Service.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.

Sip Steward is currently in beta. By participating in our beta program, you acknowledge that the Service is still under development and may contain bugs or errors. Your feedback is valuable in helping us improve the Service. Beta users may receive special benefits when we launch our full service.
